General terms and conditions of sale for the webshop

The consumer has the right to inform Plaizier that he or she is renouncing the purchase, without payment of any charge and without giving a reason, within a period of 14 days starting from the day following the delivery of the product.

Article 1: General provisions

The electronic webshop of Uitgeverij Plaizier, a private limited liability company (bvba) with registered office at 1020 Brussels, Belgium, VAT BE 0443 463 412, hereinafter referred to as “Plaizier”, offers its customers the opportunity to purchase online.
These General Terms and Conditions apply to all articles in the assortment and to each purchase made by the customer with Plaizier.

The customer accepts that these Terms and Conditions shall apply exclusively, to the exclusion of the customer’s own general or specific terms and conditions (including purchasing terms and conditions), even if these should stipulate that they are the only ones applicable.

Article 2: Price

All prices stated always include VAT and all other taxes that the customer is obliged to pay. If shipping, reservation or administrative costs are charged, they are specified separately.
The price stated refers exclusively to the articles as described verbatim. The accompanying photo is intended to be decorative and may contain elements of articles that are not included in the price.

Article 3: Offer

Each offer is only open to customers living in the European Union and the USA.

Despite the fact that the catalogue and website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up to date.
If you have specific questions about, for example, sizes, colour, availability, delivery time or delivery method, we ask you first to contact our customer service department (see article 12).

Plaizier is only bound by a best efforts obligation with regard to the accuracy, up-to-dateness or completeness of the information provided. Plaizier cannot be held liable for material errors, misprints or printing errors.

The offer is valid as long as stocks last and can at all times be adjusted or withdrawn by Plaizier.

Plaizier is entitled – without giving reasons – to refuse orders, to adjust delivery terms, to split deliveries or to attach other conditions to the delivery.

Article 4: Online purchase

The customer has the opportunity to purchase articles from the assortment online.

The purchase is concluded at the moment when the customer receives a confirmation email from Plaizier. The articles are delivered to the customer’s home on the delivery date indicated in the confirmation email.

The customer can choose between the following payment methods:

  • via credit card
  • via bank transfer
  • via Bancontact, IDEAL, SOFORT, GiroPay

Article 5: Retention of title

The articles delivered remain the exclusive property of Plaizier until the moment of full payment by the customer.
However, the risk due to loss or damage passes to the customer upon delivery. The customer undertakes, if necessary, to refer third parties to Plaizier’s retention of title, for example, to anyone who might come to seize the articles that have not yet been fully paid for.

Artikel 6: Sancties voor niet-betaling

Without prejudice to the exercise of other rights available to Plaizier, in the event of non-payment or late payment, the customer, by operation of law and without notice, shall owe interest of 10% per year on the amount not paid. Furthermore, the customer, by operation of law and without notice, is liable to Plaizier, for a fixed compensation of 10% of the amount in question, with a minimum of EUR 25 per invoice.
Without prejudice to the above, Plaizier reserves the right to take back the articles that have not yet been (fully) paid for.

Article 7: Complaints

Any visible damage and/or qualitative shortcoming of an article or other shortcoming with the delivery must be notified immediately, on penalty of forfeiture of any right.

Article 8: Guarantee

a. Legal guarantee (only for consumers)

Under the law of 21 September 2004 on the protection of consumers with regard to the sale of consumer goods, the consumer has legal rights.
Every article is subject to the legal guarantee as from the date of purchase by (or delivery to) the first owner.
Any commercial guarantee does not prejudice these rights.

b. General

In order to make a claim under the guarantee, the customer must be able to present the proof of purchase.

For items purchased online and delivered to the customer’s home, the customer must first contact the customer service department, after which the customer must return the article to Plaizier at the customer’s own expense.

Any defect must be reported by the consumer within a period of 2 months after it has been detected by the consumer. After that, any right to repair or replacement lapses.

The (commercial and/or legal) guarantee never applies to defects arising as a result of accidents, neglect, falls, abnormal or incorrect use, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or the manual, adjustments or changes to the article, heavy-handed use, poor maintenance, abnormal or incorrect use.

It is also not applicable to articles with a shorter lifespan or to wear articles.
Defects that become apparent after a period of 6 months following the date of purchase (or delivery if that is applicable), are not considered to be hidden defects, unless the Customer can prove otherwise.

The guarantee is not transferable.

Article 9: Right of withdrawal

The provisions of this article only apply to customers who purchase items online in their capacity as consumers:
The consumer has the right to inform Plaizier that he or she is renouncing the purchase, without payment of any charge and without giving a reason, within a period of 14 days starting from the day following the delivery of the product.
Customers who wish to exercise the right of withdrawal must contact Plaizier customer service within 14 days of the delivery and return the goods at their own expense within 20 days of delivery of the goods to Plaizier, Oud Korenhuis 30, 1000 Brussels.
Goods with a sales price of EUR 100 or more must be returned to us by courier (DHL, Fedex, etc).
Only items that are in the original and undamaged packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.

The following shall not be taken back under any circumstances:

  • used, soiled, damaged or incomplete articles
  • articles for which the packaging (or part of it) has been opened
  • articles tailor-made for the customer
  • items which by their very nature cannot be returned

Article 10: Privacy

Plaizier undertakes to use your data exclusively for the execution of the agreement that you entered into by reason of your order and in order to send you information from Plaizier without obligation. If you also wish to receive information via email, please also provide your email address.

We treat your data as confidential information and shall never pass them on, lease them or sell them to third parties. At all times, you can inspect your data, correct them, change them or have them deleted from the Plaizier customer file and you can refuse to consent to Plaizier using your data to send you information. A request in writing to the following address is sufficient: Plaizier, Oud Korenhuis 30, 1000 Brussels.

The customer himself or herself is responsible for keeping his or her login details confidential and for the use of his or her password. Your password is stored in encrypted form, therefore Plaizier does not have access to it.
Plaizier strictly respects the Belgian law of 8 December 1992 on the protection of privacy in the processing of personal data. You have access via your user profile to all the available data about you at Plaizier.be and can view, modify and delete them.
Plaizier.be makes use of cookies. Cookies are a standard internet technology that allow certain information to be stored and accessed on the user’s system. Cookies cannot be used to identify people; a cookie can only identify a machine. Every internet user can set up his or her computer in such a way that cookies are not accepted. If your computer does not accept cookies, you may experience problems during the ordering process. If this is the case, please contact us so that we can place the order for you.
Plaizier keeps online (anonymous) visitor statistics to see which pages of the website are visited and to what extent. If you have any questions about this privacy statement, please contact us at info@plaizier.be.

Article 11: Impairment of validity – non-renunciation

If any provision of these Terms and Conditions is declared invalid, illegal or void, this shall in no way affect the validity, legality and applicability of the other provisions.

Plaizier’s failure at any time to enforce any of the rights listed in these Terms and Conditions, or to exercise any right thereof, shall never be deemed as a renunciation of such provision and shall never affect the validity of these rights.

Article 13: Changes to terms and conditions

These Terms and Conditions are supplemented by other terms and conditions explicitly referred to, and by the general terms and conditions of sale of Plaizier. In the event of a contradiction, these Terms and Conditions prevail.

Plaizier may change these Terms and Conditions at any time without further notice. Any purchase after a change implies acceptance by the customer of these new Terms and Conditions.

Article 14: Proof

The customer accepts that electronic communications and backups can serve as proof.

Article 15: Applicable law – Competent court

Belgian law applies, with the exception of the provisions of private international law regarding applicable law and of the Rome I regulation on international sales contracts concerning moveable property. In the event of any disputes, the courts of Brussels have exclusive jurisdiction.
